房屋买卖合同

甲方（卖方）：身份证件号码：

根据《中华人民共和国合同法》、《中华人民共和国城市

房地产管理法》及有关法律、法规的规定，买卖双方在平等、

自愿、公平、协商一致的基础上就本合同所涉房地产转让事宜，

达成如下协议：

第一条：甲方自愿将其房屋出售给乙方，乙方已充分了解

该房屋具体状况并自愿购买。该房屋具体状况如下：

该房屋占用范围内的土地使用权随该房屋一并转让，相关

权益也随之转让。

出卖人还应当将附属于该房屋的阳台、走道、楼梯、电梯、

楼顶、装修、卫生间、院坝、地下室、其他设施、设备，转让

给买受人，其转让价格已包含在上述房屋的价款中，不再另行

支付价款。房屋及附属设施见清单（附件二）。

第二条：甲方保证已如实陈述上述房屋权属状况和其他具

入凭证作为付款的有效证明。

第五条：

1、甲、乙双方定于正式交付该房屋；甲方应在正式交付

房屋前腾空该房屋。

2、本合同规定，房屋转让时不受任何限制，包括但不限

于查封、冻结、抵押、共有人反对等情况。

3、甲方保证未与任何第三方签署房屋转让合同，并承诺

在本合同签署后及时办理将房屋过户到乙方名下的手续。

4、甲方必须在合同规定的时间内及时办理房屋过户手续，

否则将承担违约责任。若在规定日期或时间前未办妥过户手续，

乙方有权依法申请强制过户。

11、甲、乙双方向房屋权属登记机关申请所有权转移登记，

1.甲方应缴清自交房之日之前的物业管理、水、电、燃气、

有线电视、通讯等一切与该房屋相关的费用。由此引发的纠纷

由甲方自行处理，与乙方无关。

2.甲方向乙方提交房屋全套钥匙，并共同清查确认电、水、

煤气等度数。

3.甲方应协助乙方办理物业管理的相关入户手续。

4.甲方应协助乙方办理水、电、煤气、有线电视、通讯等

相关的更名手续。

5.甲方应向乙方提供房屋的维修基金、物业管理费押金等

相关收据。

6.甲方应向乙方提供附属设施的设备及保修卡。附属设施

详见清单（附件二）。

14、本合同未涉及的事项，甲、乙双方可另行订立补充条
